Slip Reservation & Rental Contract

TUSCARORA YACHT CLUB, INC.
(2025 Season)

1. Reservation & Deposit

• A non-refundable $250 dock reservation deposit is required to secure a slip for the upcoming boating season (May–October).
• Reservations may be rescinded up to one week prior to your vessel's scheduled launch; thereafter, the member is responsible for the full balance.
• Slip reservations and deposits are due by November 15, of the current year.

2. Membership & Ownership

• Dock rental is available only to full members in good standing. Slip assignments consider the vessel’s dimensions and member seniority.
• The slip reservation applies for the May–October season and entitles the member (and vessel owner) to occupy the assigned slip.

3. Ownership & Transfer

• Slip usage is assigned to a specific vessel and its registered owner. If the vessel is sold, gifted, inherited, or otherwise transferred, the associated slip reservation does not automatically transfer to the new owner.
• Any proposed change in vessel ownership must be reported in writing to the Fleet Captain at least 7 days prior to the transfer.
• The slip reservation will automatically terminate unless the Tuscarora Yacht Club (TYC) Board approves the new owner, who must:

1. Be a full member in good standing.
2. Submit proof of required insurance.
3. Pay any outstanding slip fees and execute a new slip contract.

4. Continuous Liability

• Original vessel owners/members remain liable for all slip fees, late fees, legal costs, and any expenses (including removal or disposal) until the new owner is approved and a new contract is in place.

5. Proof of Insurance

• Members must maintain current marine and liability insurance, naming TYC as an “additional insured” or otherwise providing protection for the Club.
• If insurance lapses, the slip contract is immediately void, and the Club may remove the vessel at the owner's expense.

6. Abandonment, Non-occupancy & Termination

• A vessel is deemed abandoned if:
  a) Slip fees remain unpaid for 30 days beyond the due date.
  b) The vessel remains in a slip after contract termination without written approval.
• Upon abandonment, TYC may, at its discretion and with reasonable notice, remove, store, or dispose of the vessel. All associated costs fall upon the owner (original or successor, per clause 4).

7. Lien Rights & Disposition

• If slip fees or related charges are not paid, Tuscarora Yacht Club (TYC) has the legal right under New York law to place a lien (a legal claim) against the vessel and its equipment.
• TYC may enforce this lien by removing, storing, or selling the vessel to recover unpaid fees and expenses.
• All costs of enforcement, including legal fees, storage, and disposal, will be the responsibility of the vessel owner.

8. Indemnification & Limitation of Liability

• Members indemnify TYC, its officers, directors, and agents against any claims, damages, or costs relating to the vessel, its operation, or transfer.
• New York law upholds liability-limitation clauses between sophisticated contracting parties, though such clauses may not protect against gross negligence or willful misconduct

9. Uncontrollable Event

• If something big and unexpected happens—like a major storm, flood, government shutdown, or anything else outside of TYC’s control—and the club can’t provide dock space because of it, TYC isn’t responsible for any losses or damages that result.

10. Entire Agreement

• This document constitutes the entire agreement between the members and TYC regarding slip rental. Any modifications require written agreement signed by both parties.
